LA VUELTA DEL MUNDO Booking Terms and Conditions
CONTRACTUAL SUBJECT MATTER
These terms and conditions govern the legal relationship between YOU and LA VUELTA DEL MUNDO (SWISSTOURER) for the services offered by LA VUELTA DEL MUNDO.
1. RESERVATION OF A WORKSHOP AND BIKE RENTAL AGREEMENT
1.1 The contract between you and LA VUELTA DEL MUNDO becomes effective from the moment of booking and payment for a service. By registering, the rights and obligations from the contract and the terms and conditions become immediately valid. When booking and paying through our website, you will receive a confirmation email with a copy of the agreement between you and LA VUELTA DEL MUNDO. From the moment of payment, the general terms and conditions apply. For reservations processed not through our website, a processing fee of CHF 50 per registered person will apply.
1.2 If the booking person registers other participants, they are responsible for their contractual obligations (including payment of the travel price) just as for their own obligations.
2. PRICES AND PAYMENT TERMS
2.1 PRICES
The prices of the services offered by LA VUELTA DEL MUNDO are in Swiss Francs (CHF). The prices for the offered services are described on the website.
For reservations by mail or email, processing fees of CHF 50 per person apply. When booking through our website, no registration fees are charged.
2.2 PAYMENT TERMS
All financial fees (transfers, bank cards, credit cards, Twint, etc.) are at the customer's expense.
2.3 CHANGES IN WORKSHOP PRICES
LA VUELTA DEL MUNDO reserves the right to change the prices of its workshops, the workshop program, or certain services included in the workshop. The impact on the price will be communicated at the same time as the program or service change. Prices may be increased for reasons such as changes in taxes or fees.
3. SERVICES
Customers can refer to the descriptions of services on the LA VUELTA DEL MUNDO website. The program includes essential parameters that are part of the workshops and will not be changed unless all members of a group explicitly wish to do so (e.g., because all participants already have sufficient experience in a certain area and prefer to focus on other applications). If there is a need to change certain less important program points for specific reasons, the customer will be informed before or during the workshop.
LA VUELTA DEL MUNDO's services apply exclusively during the agreed time and duration. Both parties are responsible for their arrival and being on time. Travel costs, meals, and all other expenses are not covered by Swisstourer.
4. PROGRAM CHANGES
4.1 CHANGES ON OUR WEBSITE
LA VUELTA DEL MUNDO expressly reserves the right to change service descriptions on the website at any time. Note: Changes are generally minor and usually beneficial to the participants, typically because it has been a request from many participants.
4.2 CHANGES AFTER YOUR BOOKING
LA VUELTA DEL MUNDO also reserves the right, in your interest, to make changes to individual agreed services if unforeseeable or inapplicable circumstances require it. LA VUELTA DEL MUNDO will endeavor to offer you equivalent replacement services. In particular, LA VUELTA DEL MUNDO is not liable for changes in the workshop program due to force majeure or official measures for which LA VUELTA DEL MUNDO is not responsible.
4.3 YOUR RIGHTS IF CHANGES ARE MADE AFTER THE CONTRACT IS CONCLUDED
If changes to individual agreed services result in a significant difference in one or more essential contract points, you have the right to withdraw from the contract within 5 days after receiving our notification.
5. CANCELLATION, CANCELLATION OF WORKSHOPS, OR BIKE RENTALS
General information: The date of change or cancellation corresponds to the working day of receipt of the information by LA VUELTA DEL MUNDO; for Saturdays, Sundays, and public holidays, the next working day is decisive. This applies to all communications by email, voice message, postal letter, etc.
5.1 CANCELLATION/CANCELLATION OF THE WORKSHOP OR BIKE RENTAL DUE TO REASONS WITHIN YOUR CONTROL
The customer can cancel the workshop and the bike rental contract up to 5 days before the start of the workshop. The conditions are described in point 5.1.1. Cancellation must be made in writing and addressed to LA VUELTA DEL MUNDO. The cancellation fees amount to CHF 45 per person. Financial transfer fees will be charged, and we advise you that our website operator charges 15 Euros (or the equivalent in CHF) for each refund transaction. All fees will be deducted directly from the refund amount.
5.1.1 For workshops and bike/e-bike rentals, the following rebooking and cancellation conditions apply. The costs are calculated as a percentage deducted from the total amount of the reservation:
Until 30 days before the workshop and/or the start of the bike rental: 20%
29 – 15 days before the workshop and/or the start of the bike rental: 40%
14 – 10 days before the workshop and/or the start of the bike rental: 50%
9 – 6 days before the workshop and/or the start of the bike rental: 75%
From 5 days before the start of the workshop and/or the start of the bike rental, the right to a refund expires. If the customer does not appear at the agreed time and, therefore, does not use LA VUELTA DEL MUNDO's services, no refund will be given.
5.2. CHANGES REQUESTED BY THE CUSTOMER TO THE REGISTRATION
If the customer wants to change the date and/or participate in a different workshop, a processing fee of CHF 40 will be charged, provided that the customer organizes a participant to take their place. If LA VUELTA DEL MUNDO has a waiting list and another person takes the free slot of the workshop, there will be no additional costs. If LA VUELTA DEL MUNDO needs to find a replacement for you, §5.2.2 applies.
5.2.1 A second change can only be granted with the approval of LA VUELTA DEL MUNDO. If LA VUELTA DEL MUNDO does not approve, and the customer still cannot attend the workshop, they can cancel their reservation according to §5.1.
5.2.2 If LA VUELTA DEL MUNDO can fill the workshop (for example: maximum 6 people), there are generally no additional costs for our customers. If the workshop is not fully booked, the following costs will be added to the processing fees. The costs are calculated as a percentage deducted from the total amount of the reservation:
Until 30 days before the workshop and/or the start of the bike rental: 20%
29 – 15 days before the workshop and/or the start of the bike rental: 30%
14 – 10 days before the workshop and/or the start of the bike rental: 50%
9 – 6 days before the workshop and/or the start of the bike rental: 75%
All fees will be deducted directly from the refund amount. From 5 days before the start of the workshop and/or the start of the bike rental, the right to a refund expires. If the customer does not appear at the agreed time and, therefore, does not use LA VUELTA DEL MUNDO's services, no refund will be given.
5.3. REPLACEMENT PARTICIPANT
If someone else replaces the originally registered participant, a processing fee of CHF 40 will be charged. Payment can be made through our website (by credit card), bank transfer, TWINT, or by paying an invoice sent by email. Once payment is received, a confirmation email will be sent to the new participant(s). From the moment of payment, the regulations described here apply between the replacement participant and LA VUELTA DEL MUNDO.
CAUTION: Since the workshop or bike rental was paid for by the originally registered participant, the conditions described here apply until the end of the reserved workshop. If rebooking fees are not paid before the workshop, §5.1 and §5.1.1 apply. LA VUELTA DEL MUNDO strongly recommends that the original participant pays these fees themselves because LA VUELTA DEL MUNDO is not responsible for transferring money (e.g., the workshop fee) between the original participant and their replacement. LA VUELTA DEL MUNDO disclaims any liability in this regard. In all cases, the regulations described under §5, §5.1, §5.2 apply.
5.4. FORCE MAJEURE
Events of force majeure (e.g., natural disasters, epidemics, unrest), official measures, and other unforeseeable circumstances may cause LA VUELTA DEL MUNDO to cancel the workshop and suspend the rental of our bikes and e-bikes. In such a case, LA VUELTA DEL MUNDO will inform you promptly by email or phone.
5.5. YOU PARTICIPATE IN A WORKSHOP BUT CANNOT COMPLETE IT
If you prematurely terminate the booked workshop, the price cannot be refunded. In urgent cases (e.g., your own illness or accident, severe illness, or death of a close person), LA VUELTA DEL MUNDO may either refund a part of the fee or integrate you into a workshop at a later date if there are available slots.
6. CANCELLATION BY LA VUELTA DEL MUNDO
For all workshops, a minimum number of 3 participants is required for them to take place (exceptions are sometimes possible). LA VUELTA DEL MUNDO reserves the right to cancel the workshop up to 2 weeks before it start. All fees already paid will be fully refunded. No additional compensation will be paid.
If the course of the workshop is endangered, significantly impeded, or made impossible due to force majeure, official measures, political unrest, strikes, or other unforeseeable and unavoidable complications, LA VUELTA DEL MUNDO may cancel the workshop at any time. Already paid fees will be fully refunded. No additional compensation will be paid.
LA VUELTA DEL MUNDO reserves the right to cancel a customer's participation for valid reasons. For example, if it is clear that the customer does not meet the participation requirements, i.e., if their participation in one of our workshops is not possible, the responsibility lies with the customer. In this case, the cancellation costs described in § 5.1 apply. §5 and especially §5.1.1 apply, unless LA VUELTA DEL MUNDO finds a replacement. In that case, only the processing fees according to §5.1 will be charged.
6.1 CANCELLATION FOR OTHER REASONS BY LA VUELTA DEL MUNDO
LA VUELTA DEL MUNDO is entitled in exceptional cases to cancel workshops for other reasons (e.g., severe illness, injury, etc., of the course instructor). If this happens, you will be informed immediately.
6.2 CANCELLATION BY SWISSTOURER OF A PERSONA NON GRATA
SWISSTOURER also reserves the right, in exceptional cases and immediately prior to any activity (e.g. a workshop), to exclude individuals from our activities (e.g. if employees of SWISSTOURER have been or are excluded by those individuals or their institutions; individuals who have previously attracted negative attention, etc.).
If any payments have been transferred, they will be fully refunded ON THE FIRST OCCURANCE. The excluded participant will be informed of our decision by SMS or email and notified that he or she will receive a 100% refund.
For any further attempt by the excluded person to register again for activities of SWISSTOURER, only the full amount LESS EXPENSES AND ADMINISTRATIVE FEES (CHF 40.–) will be refunded.
7. PARTICIPATION CONDITIONS AND PARTICIPANTS' DUTY TO COOPERATE
Each participant must meet the conditions that enable them to participate in a practice-oriented workshop and cycling activities. The participant must decide for themselves whether their physical condition and/or the environment (weather, etc.) allow them to participate in the planned activities of the workshop and whether the described activities are suitable for them. The participant must inform LA VUELTA DEL MUNDO about any difficulties. Participants must follow the instructions of LA VUELTA DEL MUNDO and its staff.
For all our workshops except the "Overseas Travel Workshop - 4 Hours," participants must bring their own bicycle in working condition or rent one to participate. Without the use of a bicycle, participants cannot take part in the activities conducted during our workshops.
If a participant continuously disrupts the group of a workshop and jeopardizes their own life, the life of one or more other participants, or a third party, LA VUELTA DEL MUNDO has the right to exclude the participant from the workshop. In this case, no compensation will be paid to the excluded person, and any additional costs incurred will be borne by the excluded participant.
7.1 RENTAL OF BIKES AND EQUIPMENT
The user is responsible for the rented bikes and equipment. In case of damage, it is essential to inform LA VUELTA DEL MUNDO or the workshop leader immediately. The user, or their Liability Isurance, is liable for any damages caused by them. As LA VUELTA DEL MUNDO has a mechanical workshop, we strive to keep the costs for repairing damaged bikes and equipment as low as possible for our customers. However, it is important for our participants to have liability insurance that protects them against major damages and, above all, against damages inflicted on third parties.
7.2 VIDEO RECORDINGS AND PHOTOS DURING LA VUELTA DEL MUNDO WORKSHOPS
Swisstourer protects its intellectual property. Participants of LA VUELTA DEL MUNDO workshops, under the LA VUELTA DEL MUNDO terms and conditions described here, agree not to make any videos of the LA VUELTA DEL MUNDO workshops and their proceedings. Photos of workshop content may be taken to a limited extent as commemorative photos. However, it is prohibited to create a number of photos that could jeopardize LA VUELTA DEL MUNDO's intellectual property, such as more than 10 photos per workshop theme.
The participants must not stop for photos or videos while cycling because this could disrupt and slow down the group. Photos of the region can be taken when the group is stationary.
8. WORKSHOPS OUTSIDE SWITZERLAND AND LIECHTENSTEIN
Generally, our workshops take place near Neuchâtel. However, we remind our participants that they may need a passport, identity card, and, in some cases, a valid visa if our workshops are held abroad. If you are Swiss or Liechtensteiner, LA VUELTA DEL MUNDO can inform you about the formalities for entering and staying in the respective country. If you are traveling with a different passport, it is very important to contact the authorities or the embassy of the country you are traveling to (or their official website) for information. (CAUTION: Information on the Internet is often not updated. Many pieces of information are contradictory or incorrect.)
8.1 ENTRY, VISA, AND HEALTH REQUIREMENTS
8.1.1 If travel documents need to be issued or extended, or if a visa needs to be obtained, you are solely responsible for these arrangements. If a travel document is not available or is issued too late, resulting in the need to cancel the trip, §5 (Cancellation) applies.
8.1.2 Participants of LA VUELTA DEL MUNDO workshops abroad are responsible for complying with the laws, including entry, health, and currency regulations of the country they are visiting. Before departure, please ensure that you have all necessary documents with you.
8.1.3 LA VUELTA DEL MUNDO advises you that if you are denied entry to a country, you will be responsible for the return costs. LA VUELTA DEL MUNDO expressly points out the legal consequences of possession and importation of prohibited goods (illegal substances, weapons, bio-hazard goods, animals, etc).
9. PROGRAM CHANGES DURING OUR WORKSHOPS
In the event of force majeure, very adverse weather conditions, or other circumstances that require a change in the program, LA VUELTA DEL MUNDO reserves the right to modify the course of the program. The workshop will generally take place according to the itinerary described in the program. The sequence of topics may be changed if necessary.
Any additional costs exceeding 10 CHF per person will be borne by the participants. This rule applies also in the case of force majeure.
10. INTERRUPTION OF THE WORKSHOP OR SERVICES
If a participant prematurely terminates the workshop or does not participate fully, no refund will be provided by LA VUELTA DEL MUNDO. All associated costs will be borne by the participant.
If LA VUELTA DEL MUNDO cancels the workshop during the trip without any special reason, the costs for a one-day workshop will be fully refunded. For two-day workshops, LA VUELTA DEL MUNDO will refund half of the costs if the interruption only affects one day. If LA VUELTA DEL MUNDO interrupts a two-day workshop, the costs will be fully refunded. No further compensation will be paid. §6 and §7 apply.
11. COMPLAINTS DURING THE WORKSHOP AND CLAIMS
If a customer wishes to file a complaint during our workshops or if any damage occurs, they must immediately inform LA VUELTA DEL MUNDO, i.e., the responsible person on-site at the workshop. LA VUELTA DEL MUNDO will try to find a satisfactory solution for the customer.
If no remedy is provided within a reasonable time period, or if a remedy is not possible or insufficient, ask the workshop supervisor to confirm the deficiencies or damage you are complaining about and the lack of remedy in writing. The workshop supervisor is obliged to document the facts and your complaint in writing. However, you are not entitled to claim any damages or similar demands from the workshop supervisor.
All complaints must be submitted in writing to LA VUELTA DEL MUNDO within a period of 30 days after the completion of the workshop or after the occurrence of the issues in question.
If the workshop participant has not reported their dissatisfaction to the responsible person on-site during the workshop or if they do not assert their claims within 30 days after the end of the booked workshop, the participant forfeits their right to make a complaint.
12. LIABILITY
12.1 General: LA VUELTA DEL MUNDO bears full responsibility in compliance with legal regulations and international agreements.
12.2 Disclaimer: LA VUELTA DEL MUNDO is not liable, particularly in the following cases (non-exhaustive enumeration):
12.2.1 When LA VUELTA DEL MUNDO has taken all necessary precautions and the damage was unforeseeable or if the precautions taken by the service provider were unavoidable, especially in the case of force majeure.
12.2.2 Damages caused by the unforeseeable or unavoidable fault of a third party who is not related to the fulfillment of the contract.
12.2.3 Damages resulting from an error or mistake of a participant before or during the workshop.
12.3 PERSONAL INJURIES, ACCIDENTS, AND ILLNESSES
LA VUELTA DEL MUNDO is liable for personal injuries, death, bodily harm, and illness that result from non-fulfillment or improper fulfillment of the contract, provided that the damages are caused by LA VUELTA DEL MUNDO.
12.4 PROPERTY AND FINANCIAL DAMAGES
Regarding property damages resulting from non-fulfillment or improper fulfillment of the contract, LA VUELTA DEL MUNDO's liability is limited to a maximum of the price of the workshop unless the damage was caused intentionally or with gross negligence.
12.5 PARTICIPANT'S EQUIPMENT
If the participant uses their own bike and equipment, they are fully responsible, especially for transportation, proper usage, and respect towards others. If the participant cannot continue or needs to temporarily interrupt the workshop due to their equipment (e.g., an unrideable bicycle, insufficient warm clothing, etc.), Section § 10 applies.
12.6 DELAYS
LA VUELTA DEL MUNDO is not responsible for delays of our participants, public transportation, or traffic jams on the way to the workshop. Participants are advised to consider traffic conditions, potential delays with individual or public means of transport, etc., to avoid possible delays.
IMPORTANT: After the start of the workshop, the group of participants with bicycles will leave the meeting point. If you arrive late, please integrate into the group at the specified time and checkpoints listed in the program. The program is sent by email at the beginning of each workshop to those who are not yet present.
13. SAFETY
13.1 GENERAL
You participate in your sport and activities during the time of the LA VUELTA DEL MUNDO workshop at your own risk. LA VUELTA DEL MUNDO assumes no liability for any resulting accidents and/or physical damages. You are responsible for complying with the respective local traffic regulations, even when traveling with a group.
13.2 HELMET REQUIREMENT
On all courses, workshops, and tours organized by LA VUELTA DEL MUNDO, wearing a helmet is mandatory for all cyclists. If you wish to waive wearing a helmet for personal reasons, you must inform LA VUELTA DEL MUNDO in writing (e.g. e-mail, SMS). LA VUELTA DEL MUNDO will confirm your request as long as helmet wearing is not legally required. Please be aware that statistically, the risk of injury in the event of an accident is significantly higher without wearing a bicycle helmet.
14. WARRANTIES
LA VUELTA DEL MUNDO has sufficient resources to provide a refund if the customer is entitled to one, as required by this contract.
15. DATA PROTECTION
LA VUELTA DEL MUNDO (SWISSTOURER) protects your data in two ways: firstly, through our website manager directly, and also through a private company specialized in data protection. After participating in the workshop, the participant may request access to the collected data or the deletion of their data. LA VUELTA DEL MUNDO has the right to transmit the customer's data (name, address, email, phone number) to service providers such as restaurants, transportation companies, authorities, etc., as necessary for the workshop's execution.
16. INSURANCE
Liability insurance is riquired in case the participant causes harm to third parties. Travel cancellation insurance can be taken out (note: the deductible may be higher than the price of our services).
17. APPLICABLE LAW AND JURISDICTION
Swiss law applies to the legal relationship between you and LA VUELTA DEL MUNDO (SWISSTOURER). The place of performance and jurisdiction is Neuchâtel (Canton of Neuchâtel) *.
The conditions and clauses of the contract are subject to the provisions provided for in the application of laws and international agreements.
