LA VUELTA DEL MUNDO (SWISSTOURER) Terms and Conditions
for Rental Bicycles and E-Bikes

CONTRACTUAL SUBJECT MATTER
These terms and conditions regulate the legal relationship between you and LA VUELTA DEL MUNDO regarding the rental bicycles and e-bikes provided by LA VUELTA DEL MUNDO. The renter accepts the conditions described here by LA VUELTA DEL MUNDO.
1. Booking
The booking of a rental bicycle is typically made online, and the acceptance of the conditions described here, payment through the LA VUELTA DEL MUNDO website, as well as the booking confirmation, become part of the rental contract. All our customers participating in a workshop can also spontaneously rent a bicycle or e-bike on the day of the workshop. To do this, you must complete and sign the rental contract and make the payment on-site.
2. Bicycle Pickup
All rental bicycles and e-bikes from LA VUELTA DEL MUNDO are handed over at the LA VUELTA DEL MUNDO bike shop at Rue de Fontaine-André 5, 2000 Neuchâtel, along with accessories. Before starting the ride, it is the renter's responsibility to check the functionality of the brakes and gears of the bicycle. If noticeable damage or technical issues are identified, they must be reported to LA VUELTA DEL MUNDO immediately.
3. Vehicle Usage, Restrictions
The renter must adhere to the Swiss traffic regulations, just like all other road users, and must not violate them. The renter may only use the bicycle or e-bike if they are fit to ride. Using the LA VUELTA DEL MUNDO bicycle or e-bike in a condition or under the influence of substances that could impair their ability to ride contradicts this regulation and is largely contrary to the traffic regulations. The renter operates the LA VUELTA DEL MUNDO bicycle or e-bike responsibly, as they, or their liability insurance, are responsible for damages caused to the LA VUELTA DEL MUNDO bicycle or e-bike, as well as damages to third parties and objects. The renter is not allowed to carry a passenger (children properly strapped in a child seat are exempt from this rule) or use the LA VUELTA DEL MUNDO bicycle or e-bike in a way that deviates from its intended purpose. If the LA VUELTA DEL MUNDO bicycle or e-bike is stolen due to a lack of care and caution, the renter, or their liability insurance, is responsible for the resulting damage. In this case, the stolen LA VUELTA DEL MUNDO bicycle or e-bike must be replaced with an identical or better one, paid for by the renter or their insurance.
4. Vehicle Return
The LA VUELTA DEL MUNDO bicycles and e-bikes are exclusively meant for use in the LA VUELTA DEL MUNDO workshops. If the renter leaves the workshop before its completion, they must return the LA VUELTA DEL MUNDO bicycle or e-bike to the LA VUELTA DEL MUNDO bike shop at Rue de Fontaine-André 5, 2000 Neuchâtel, before the workshop concludes. If the renter violates this rule, they will be charged the resulting additional costs. IMPORTANT INFORMATION: Additionally, a fine of 500 Swiss francs will be charged, as expressly stipulated in this contract and accepted by the renter. The accessories provided with the LA VUELTA DEL MUNDO bicycle or e-bike (charger, lock, key, bicycle helmet, and other non-listed accessories) must be returned in perfect condition and in full when the vehicle is returned. Lost or stolen accessories must be reimbursed or paid for by the renter.
5. Services and Prices
All prices indicated on the LA VUELTA DEL MUNDO website at the time of booking, or when the renter makes the payment, apply. LA VUELTA DEL MUNDO reserves the right to change prices. However, LA VUELTA DEL MUNDO cannot retroactively claim the difference resulting from a price increase if the customer has already paid through the website.
6. Cancellation of Bicycle or E-Bike by the Renter
For workshops and bicycle / e-bike rentals, the following rebooking or cancellation conditions apply. The costs (fees) are calculated as a percentage of the total reservation amount:
Up to 30 days before the workshop and/or the start of bicycle rental: 20%
From 29 to 15 days before the workshop and/or the start of bicycle rental: 40%
From 14 to 10 days before the workshop and/or the start of bicycle rental: 50%
From 9 to 6 days before the workshop and/or the start of bicycle rental: 75%
From 5 days before the workshop and/or the start of bicycle rental, there is no entitlement to a refund.
If the customer does not appear at the agreed time and therefore does not use LA VUELTA DEL MUNDO's services, no refund is provided.
Additional fees are added for all financial transactions, and it is noted that our website operator charges 15 euros (or the equivalent in CHF) per transaction in case of refund. All fees are deducted directly from the refunded amount.
7. Delay
LA VUELTA DEL MUNDO assumes no responsibility for delays of our participants, public transportation, or traffic jams on the way to the workshop or for the pick-up/return of the rental bicycle or electric bicycle. Participants are advised to consider traffic conditions, potential delays in various modes of transportation, etc., to avoid possible delays.
8. Accident, Property, and Liability Insurance
The renter confirms on the website or by their signature of the rental agreement that they have liability insurance with sufficient coverage that covers the risks of riding the bicycle or e-bike. All costs for damages, as well as expert costs, depreciation of the rented bicycles or e-bikes from LA VUELTA DEL MUNDO and their equipment, repair or rental loss costs, fall under the renter's liability.
9. Defects During Rental Period
LA VUELTA DEL MUNDO does its utmost to provide the participants in workshops, and thus the renters, with its rental bicycles or e-bikes in perfect condition. If the LA VUELTA DEL MUNDO bicycle or e-bike has one or more defects during a workshop, the coach will do their best to fix them. If the participant is unable to continue with the workshop due to technical defects, the money paid for the affected workshop and the rental bicycle or e-bike will be fully refunded, or they can complete or repeat the workshop with a rental bicycle or e-bike for free at another time. If a LA VUELTA DEL MUNDO bicycle or e-bike experiences a problem outside of the workshops, the renter can contact LA VUELTA DEL MUNDO or have it repaired by the nearest bicycle mechanic. A receipt must be presented for a refund, clearly stating that it is the LA VUELTA DEL MUNDO bicycle or e-bike.
10. Damages
The renter has the obligation to immediately inform LA VUELTA DEL MUNDO about any damages and losses that occur. During the rental period, the renter is liable for damages that occur to the rented bicycles or e-bikes and their accessories. This includes accidents, any impact that causes damage, improper handling, minor damages, damages due to improper transportation or improper or unauthorized use, vandalism, natural influences. LA VUELTA DEL MUNDO has its own workshop specialized in touring bicycles and Bosch e-bikes and strives to keep costs low for the renter in such cases.
11. Theft
In case of theft of the rented bicycle or e-bike, or its accessories, during the rental period, the renter is liable. The vehicle must always be chained to a non-removable object (railing, streetlamp, etc.) in the absence of the renter. The loss of the rented bicycle or e-bike, or the accessories rented by them, will be invoiced to the renter at the replacement value.
12. Accident with Property and/or Personal Injury
Accidents with property damage must be reported to LA VUELTA DEL MUNDO immediately. In case of injuries, property damage to third parties, or if a third party is involved, the police must be contacted immediately, especially if the third party may have caused the accident and/or damage. The accident report provided by LA VUELTA DEL MUNDO must be duly filled out, and the renter is obligated to provide LA VUELTA DEL MUNDO with a copy.
13. Youth and Children
Children under the age of 16 must be accompanied by an adult and responsible person. Our e-bikes with support up to a maximum of 25 km/h may only be ridden by those aged 16 years and above. For riders who possess a category M driver's license, the minimum age is 14 years.
14. Use of LA VUELTA DEL MUNDO's Rental Bicycles or E-Bikes by Third Parties
The use of LA VUELTA DEL MUNDO's rental bicycles or e-bikes by third parties is only allowed with explicit permission from LA VUELTA DEL MUNDO.
15. Liability of LA VUELTA DEL MUNDO
LA VUELTA DEL MUNDO assumes no responsibility and excludes any liability for damages suffered by the customer from the execution of this contract, unless intent or gross negligence can be proven against LA VUELTA DEL MUNDO. LA VUELTA DEL MUNDO in no way assumes liability for indirect damages, consequential damages, damages to third parties, and lost profit.
16. Customer's Liability
The customer is primarily liable in accordance with the regulations contained in these terms and conditions and Swiss law. All the above-mentioned paragraphs are determinative for this purpose.
17. Insurance
Insurance (accident and property & personal liability) is the responsibility of the customer.
18. Applicable Law and Jurisdiction
Swiss law applies to the legal relationship between you and LA VUELTA DEL MUNDO (SWISSTOURER). The place of performance and jurisdiction is Neuchâtel (canton of Neuchâtel). The terms and clauses of the contract are subject to the provisions provided for by laws and international agreements.
